Chavez-Vilchez residence document: residence rights for a parent of a Dutch child

Are you the parent of a minor child with Dutch nationality? If so, you may be able to apply for a residence document based on the Chavez-Vilchez ruling. This is an important judgment of the Court of Justice of the European Union, which in certain situations gives parents of Dutch children the right to remain in the Netherlands.

What does this mean?

The Chavez-Vilchez ruling provides that a parent of a Dutch child cannot simply be expelled from the country. If, as a parent, you were required to leave the country, your Dutch child would have to follow you and would therefore also have to leave the European Union. Under European rules, this cannot happen without proper grounds.

For that reason, under certain conditions you can apply for a residence permit.

When are you eligible for a Chavez-Vilchez residence document?

You can apply if you:

  • are the parent of a minor Dutch child (including a step-parent, foster parent, or caregiver).
  • care for the child and share responsibility for their upbringing.
  • do not have the nationality of an EU/EEA country or Switzerland.
  • do not already have another right of residence in the Netherlands or another EU country.
  • have a valid passport or other travel document.
  • live in the Netherlands, or will move here with your child.
  • do not pose a threat to public order or national security.
  • the child is strongly dependent on your presence in daily life.

Does this also apply to (half-)brothers or (half-)sisters?

In some cases, (half-)brothers or (half-)sisters of the Dutch child may also receive a residence document, for example if they:

  • will live in the Netherlands together with you and the Dutch child.
  • belong to the same household.
  • are your biological or legally recognised children.
  • are under your legal authority.
  • have the consent of the other parent (or the authorities), if required.
  • are, like the Dutch child, strongly dependent on you.
