Domestic violence: from partner residence permit to an independent residence permit

Are you a victim of domestic violence and is your residence status at risk? If your residence permit depends on your (marital) partner, ending the relationship can have serious consequences. Fortunately, the Immigration and Naturalisation Service (IND) offers victims the possibility to apply for an independent residence permit.

This permit can be granted on humanitarian grounds, because domestic violence is considered an exceptional situation that deserves protection.

When are you eligible?

You may be eligible if:

  • Your residence permit is dependent on your partner.
  • The relationship has ended due to domestic violence.
  • There are no grounds to withdraw your previous residence permit.
  • You are not a threat to public order or national security.
  • You have a valid travel document, such as a passport.

What do you need for the application?

For a successful application, the following documents and supporting evidence are usually required:

General documents:

    • Copy of your passport.
    • Antecedents declaration.
    • Application form for the non-temporary humanitarian residence purpose.

Evidence of domestic violence:

      • Police report of domestic violence.
      • Medical information from a doctor or care provider.
      • Statement from the police or the Public Prosecution Service (OM) that prosecution of the perpetrator has been initiated.

Additional documents:

    • If you were unable to file a report, statements from third parties (for example care providers, neighbours, or a shelter) can be helpful to show that the domestic violence occurred.
    • Possibly a written statement from your ex-partner acknowledging the domestic violence.
