Why can your residence permit be withdrawn?

A residence permit can be withdrawn for various reasons, for example:

Reasons for withdrawal:

• Family reunification: if you no longer meet the conditions, for example because the relationship has ended
• Criminal convictions: if you have a criminal record. This can apply even if you have already been living in the Netherlands for a long time.
• Loss of employment: if you lose your job, or if your employer no longer meets the requirements, such as being a recognised sponsor.
• Loss of main residence in the Netherlands: if you have deregistered and no longer have your main residence here.
• Changes in income: if you no longer meet the income requirements of your residence permit.

What are the consequences of withdrawal of your residence permit?

When the IND withdraws your residence permit, this can have major consequences, not only for you, but also for your family members or other relatives living with you in the Netherlands:

• You lose the right to stay in the Netherlands.
• You may be required to leave the country.
• It may have consequences for future residence permit applications or naturalisation.
• A retroactive withdrawal may invalidate previous residence rights.

Can I object to the withdrawal?

Yes, in many cases you can object to the withdrawal. The IND must prove that you no longer meet the conditions for your residence permit. If this proof is insufficient, the withdrawal may be unjustified.

In addition, it is important to know that the proportionality test plays a role in the assessment of a withdrawal decision. This means that the consequences of the withdrawal must be proportionate to the objectives the IND seeks to achieve. For example, the IND may not simply take a decision that has a disproportionately severe impact on you and your family.
